Faulty Samsung Phone – Rent-to-Own

Dear Pep and Foneyami Customer Service,

I just wanna lodge a complaint regarding a Samsung phone I acquired through the rent-to-own option offered by you at Pep store Southgate Shopping Centre in Pietermaritzburg ,around January 2025. The device has unfortunately stopped charging completely, rendering it unusable.

I went to Pep store where I made the purchase, and the staff confirmed that the phone is indeed not charging. However, I was told that for the phone to be fixed, I need to provide the original box and receipt. I understand that keeping these items is important, and I acknowledge my responsibility in this regard,but I regrettably misplaced these items due to unforeseen circumstances.

My concern is since the device is linked to foneyami’s rent-to-own program, I believe your systems should have records of my contract, payments, and the device’s IMEI/serial number, which could verify ownership and warranty status without the physical box or receipt.

I believe that both Foneyam and Pep maintain records of all rent-to-own agreements and should be able to verify ownership and the device in question. I accept that misplacing documents is not ideal, but it is a common occurrence, and there should be reasonable alternatives in place to handle such cases. It feels unfair to continue paying for a device that is unusable through no fault of my own (the phone is faulty, not damaged by misuse). I urge you to explore alternative solutions to resolve this issue, such as checking your database or facilitating a repair/exchange.

As a loyal customer, I trusted this program to provide functional devices. I kindly request your intervention to find a mutually fair resolution, whether via a waiver of the documentation requirement, a payment pause during repairs, or another remedy.

I would appreciate your urgent response within to clarify how we can proceed.

I refer to the recent call I received from your agent regarding the Samsung phone I acquired under your rent-to-own agreement through the Pep Southgate branch in January 2025.
I am disappointed by your refusal to assist with the repair or replacement of a device that has become completely unusable through no fault of my own, despite the fact that I am still actively paying for it.
As previously stated, I lost the box and receipt but the device can be easily verified through your internal records using my ID number, contract details, and the phone’s IMEI. Your insistence on denying service based on missing packaging is not only unreasonable, but it also contradicts my rights as a consumer.
In terms of the Consumer Protection Act, 68 of 2008 (CPA):
  • Section 55(2) guarantees a consumer’s right to receive goods that are reasonably suitable for the purpose for which they are generally intended, and
  • Section 56(2) states that if goods are found to be defective within six months of delivery, the consumer is entitled to repair, replacement, or a refund.
I am still within the six-month statutory warranty period provided by the CPA. As such, your refusal to provide assistance places you in breach of your legal obligation under the Act. Therefore, I am left with no choice but to notify you of the following:
  • I will no longer be making any further payments for this device, as it is not functional.
  • The device belongs to Fonyami, and if you wish to collect it, you are welcome to do so.
  • Should this matter be escalated further or affect my credit standing, I will not hesitate to lodge a formal complaint with the National Consumer Commission and any other relevant regulatory body.
I would prefer to resolve this matter amicably, but I will not continue to pay for a phone that cannot be used and is being unfairly withheld from repair
