Unfair business practice and poor workmanship

My vehicle was ****** and recovered in October 2019, it had minor damages to the vehicle. This vehicle was sent to Fleet VIP on the recommendations of Budget insurance, who claimed that they were a VW approved repairer, which was not the case. On 1st November 2019 my vehicle was returned to me and still had existing damage to the vehicle. When I complained to Fleet VIP, I was told that Budget refused to pay for the repairs. I did not accept the vehicle and sent it back. I was told by Fleet VIP it is not their problem and I should contact Budget Insurance. On the 20th December I paid the excess in full to Fleet VIP, my vehicle was returned to me again, the paintwork was substandard, paint was peeling of the vehicle and the vehicle had further damages caused by gross negligence of Fleet VIP. I again returned the vehicle to Fleet VIP. From the 30th December 2019 to the 8th January there was various correspondence between myself, Fleet VIP and Telesure with regards to all the concerns. On the 17th Jan I went through to Fleet VIP to meet Derek (From Telesure) and Sylvia (Fleet VIP) to collect the vehicle. Once again the workmanship was poorly executed and further damage was sustained by Fleet VIP. On the 28th February my vehicle was delivered to my workplace and once again the workmanship was poor and further damage was caused by Fleet VIP (for example: The vehicles ECU was cable tied. Once again we returned the vehicle to Fleet VIP, where it was confirmed that the original ECU was ****** whilst in the possession of Fleet VIP and was replaced with a second hand ECU, which was not according to VW’s specifications. Upon my own investigation VW SA confirmed the ECU was not correct and coded properly. On the 20th March once again my vehicle was returned, upon inspection it was noted that my vehicle had further damages to it caused by the panelbeaters gross negligence. Once again the vehicle was not accepted and returned to Fleet VIP.

We than lodged a complaint to Budget insurance management to date the vehicle has not been repaired to standard or returned. I have been paying for vehicle installments, tracking, and various insurance policies for the last 7 months and still do not have my vehicle.

Budget has decided to write off the vehicle, even though it has minor damages, in addition they are not willing to settle the vehicle in full, which will potentially force me to pay in the shortfall and I will be left with no vehicle.

In addition I stand to lose all monies that I have invested in this vehicle for the last 2 years and 8 months. I do not understand how budget can write off my vehicle due to their gross negligence, resulting in me incurring further debt as well as being left destitute without a vehicle. It makes no financial sense how a vehicle which has had approximately R31k damages can now be written off.

Budget insurance is blatantly trying to absolve themselves of their gross negligence and is unwilling to reimburse me amicably for my loss.
