Unacceptable service.

We purchased our home on 26th of June 2018 through auction house Vans Auctioneers. The property was liquidated by First National Bank. What should have been a happy experience turned out to be costly and a nightmare. On the fall of the hammer, I was placed under duress to sign their agreement or risk losing the deposit. Van Auctioneer does not give you time to read a lengthy document nor allow this document to be proofed by your legal advisors. The agreement is drafted in my humble opinion against the purchaser. This is a document that is not fair and only protects the seller and auctioneer. This is contra the Consumer Protection Act as the document should be balanced and not favour only the seller. On signing the agreement, assume a person is unable to obtain a bond, you lose your deposit as the auctioneer takes their commission from your deposit.

This was just the beginning of my nightmare. I secured my loan from First National Bank noting that they are the bank that liquidated the property. The auctioneer and the bank failed to provide approved building plans. One should note that a building is consider *******ly constructed if there are no building plans, which will have the effect of both First National Bank and the auctioneer selling an ******* property and misleading the buyer as this was not disclosed. I am now burdened with having to pay occupational rent as the transfer of the property has been delayed as a result of possible ******* buildings (sold by FNB).

I have received poor service and the goal post shifting every time with First National Bank. They approved my home loan and when I ask the consultant to confirm that this is last information required they agree and only to receive a call later to say more information required. Irony of it is I bought a property that was liquidated by First National Bank, who provided a loan to the previous owner, they are now insisting that to finalize the loan I must provide the approved building plans.

First National Bank through the auctioneer sold a property that is *******, I stand to lose my deposit which I might add that Van Auctioneer has taken as their commission. The agreement has ambiguous clauses, I should be earning interest on my cash deposit. I have no joy dealing with both First National Bank and Van Auctioneers. Consumers should be warned when a bank sells a property without approved building plans and the auction house to protect their client passes the risk of an ******* property onto the consumer.

FNB has continuous contradicting changing requests and requirements pertaining to the building plans.City Council has provided approved plans which FNB state ” I can suggest that you approach the municipal and obtain legible copies of the plans showing that they are approved (on the attached we cannot see stamp).” The plans submitted have approval stamps with a confirmation letter stating the plans are approved. The attorneys confirm the plans are stamped and approved. The constant changes have reduced our home owners bliss to an evolving nightmare dating back to July with FNB.
