*****ulent Guarantees

My Father died in 2013. He had 2 Guarantees registered with FNB. One was for the South African Post Office and the other in favour of Eskom. After his passing his Estate was finalized and advertised. FNB apparently missed this adverti*****t about his estate and saw his account was closed. They however did not do anything about the guarantees that was issued and signed by him, but because of a 6-monthly cost of around R150 each, they decided to choose the next person with the same last name at the same bank and that was unfortunately my account. I initially thought these costs were for my own Bond I had at FBN. After my bond was paid off, the costs still appeared every 6 months and I investigated. It tuned out to be the 2 mentioned guarantees. I initiated correspondence with the executor and FNB in Upington on 27 January 2021. Since that time I have not been able to get both cancelled. Seeing that they were both initiated and signed by my deceased father, it is impossible to cancel from my side. Appeals to stop the cost being debited from my account falls on deaf ears as FNB says the costs should be borne by someone as it was not cancelled. The fault for not cancelling the guarantees is FNB's as they missed a vital ad in the Government Gazette about the passing of my father. I am still trying to get some action. I Quote the writ to FNB by the Executor on 3 February 2021:

Wyle mnr Wiehahn is gedurende 2013 oorlede en die boedel is finaliseer, goedgekeur en adverteer (21dae ter insae) vir besware gedurende Okt. 2014. Die boedel rekening (Rek no. *** ***2) is op 20 Mei 2016 gesluit nadat die laaste verdelings gedoen is aan die erfgename. Ek verstaan dus nie hoe daar moontlik nou nog enige waarborge kan bestaan wat FNB hou nie.

Die Meester van die Hooggeregshof het die boedel rekeninge goedgekeur en bekragtig en toestemming vir finale liassering gegee

-------- The local person at the Upington Branch tries her best but no-one at Head Office even answers a phone - let alone investigating these obsolete guarantees. ------ Again I do not have the authority to cancel the 2 guarantees as my father was the signee. Also the cost I have had to bear I want paid back in full plus interest!
