Transactions on account in deficit WITHOUT overdraft
During the month of April 2018, I logged a call with FNB Banking, I was charged for transactions I made on my FNB Cheque account, while it was in a deficit. The problem with these charges, is that I do not have an overdraft on my account, and was only notified that my account was in a deficit AFTER the transactions had been approved, causing me to be charged multiple R110 honour fees for each transaction approved.
In the days to follow, I noticed how much I was in a deficit, and would deposit amounts to get my account back into the positive, but following each deposit, I was charged more and more honour fees. At the start of it, I was around R1400 in the deficit. Overall, I had paid R2120 back into the account, but fees kept being deducted AFTER I deposited money into the account to return the account into a positive, and overall I was charged R1100, and was still in a deficit. I then deposited another R1000 into my account, which has now put me in a positive balance, but I am left with R500 for the rest of the month, and I've transfered all my savings and additional funds I had already, which were 'lost' due to more of the honour fees being charged.
I then contacted and logged a call with FNB to explain the situation (Thursday 12th April 2018), and to request feedback on how and why it happened, but at first did not receive any feedback, although I was promised I would be contacted in 24h. This morning (Thursday 19 April 2018) I contacted them again, as I had not yet received any feedback.
This morning I had to again explain to another agent what happened. I had gone through FNB's Cheque Account T&Cs (see https://www.fnb.co.za/downloads/terms/Cheque-and-Card-FNB-Terms-and-Conditions-06-September-2013.pdf), which on page 7, under point 5, states that FNB have the right to decline transactions due to insufficient funds, which in this case did not happen. I asked the FNB agent why, if I have no overdraft, were my transactions not declined, to which he answered that it's not the BANK (FNB) that should decline it, but the vendor/shop itself, and that they have the right to honour my transactions if the shop does, and then charge me an honour fee for each transaction (R110 each).
This clearly does not match their own T&Cs for Cheque accounts, and although I had shown it to the agent(s) I spoke to, they kept referring to it being my responsibility to log into the banking app and monitoring my own balance, and that the SMS messages received are NOT accurate, and are not to be used as a means of budgeting, but just for convenience (not sure what convenience, since they are inaccurate and should not be used, according to the agents).
Being a private client, I believe this is TOTALLY unacceptable, extremely bad service, and does not match their own T&Cs. I have requested they refund these amounts, but FNB says it has the right to charge me these, but how can they, if THEY approved the transactions when the account was in a deficit, AND if I only received an SMS approx. a week after it went into a deficit?
I hope somebody can assist with this urgently.
