Sales under false presence

Hi all,<br> <br> An FNB Sales agent sold me a phone in January 2014 informing me that the phone is both sand and water proof, upon receiving the phone it was exposed to water and mud and was damaged. I then called FNB and Cell C to get assistance to listen to the telephone conversation between the sales rep and myself and they indeed found out that the representative said the phone was water proof. I was then informed that they will take the phone back and give me a new Sony Erricson Xperia E63 but I should know that it is not water proof. <br> <br> I am here today because I have not received a new phone and also because I am still paying this bill but have never used this phone ever.<br> <br> I called Cell C and they informed me that I should send it to the repair shop, and I did so but the phone was returned due to it being exposed to water. <br> <br> I then stopped paying the account and now I am dealing with debt collectors for a phone I never used not even once. Can you advise me on how to handle this issue.<br> <br> I just feel that if sales people are going to use sneaky tack-ticks to sell products the company should react on the matter. Thank you.
