Poor service
Good Day,
I logged a claim a couple of weeks ago regarding the house I am purchasing, and there were issues with the plans. According to the OTP, the seller is supposed to produce updated building plans. However, the building plans had to be submitted to the municipality, and they were rejected due to changes the seller needs to make.
Before the building plans were rejected, I reached out to FNB Law and spoke to Phathiswa about the possibility of withdrawing from this deal since the process was taking longer than expected. She informed me that I did not have grounds to cancel the deal unless the building plans were not approved.
On the 18th of July, I received feedback from the seller that the council had rejected the building plans. I forwarded that email to Phathiswa but did not receive a response.
I then emailed the seller to cancel the deal due to the failure to get the plans approved. However, the conveyancer responded that I would be liable for 90% of the transfer fees because my bank (FNB) did not perform due diligence in time. They claimed they had sent feedback regarding the building plans during the last phase of property registration.
Someone from FNB tried to call me on Friday, but I was unable to take the call. I tried to return the call but was unsuccessful. They sent an email stating that I can't just cancel the deal, despite me providing all the necessary details in my emails.
I am writing to request your urgent intervention. I even wrote a letter and asked FNB Law to confirm if I could forward that email to the conveyancer, but no one has responded.
It has been a week since I forwarded the email from the conveyancer. I took this policy to have peace of mind in situations like this, but I am not happy with the quality of service I am receiving from FNB Law.
