Maladministration, it just gets better with FNB hey???

So my case came back from the Banking Ombudsman and I’m appalled at FNB’s response. Firstly, they knew from day one, I was self employed and made a statement in their response to the Banking Ombudsman that I declared I was permanently employed which is ridiculous. I remember that at the very beginning when I started dealing with FNB, they requested an ITA34 document for a credit card application because again, they knew I was self employed. And that request was made by my banker at that time. Now tell me how was I captured as permanently employed? They also made a statement that I was captured as permanently employed when they again knew I was self employed. As per FNB’s response, “ If the Consumer is self-employed the insurance is still compulsory, however the inability to earn an income/retrenchment benefit is excluded from the Customer Protection Plan premium. The consumer is then only charged premiums for Death, Permanent and Temporary disability”. So they exclude “the inability to earn income benefit” for self employed people like myself and yet they still claimed on it? Is that even legal? Of forgot to mention one FNB consultant told me that they honored the claim under the inability to earn income because they were like helping me out? Really? Nobody helps for nothing!!

“ The Customer Protection Plan (CPP) cover on the loan account is determined by the Consumer’s type of employment at the inception of the loan application. The Consumer’s employment status was captured as permanently employed therefore the Customer Protection Plan on his loan accounts catered for all the benefits therefore was billed accordingly” . Oh Really FNB? So even though FNB knew I was self employed, they capture me as permanently employed?? Was this all done to get the loan as a new sale??? Also another statement the responder made was that I sent through three months bank statements as a matter of her defence so I think in her position at FNB, she should know that self employed people also generate their payslips. A very poor comeback as defence is all I can say.

“ The Credit Agreement for the loan accounts *** and *** were concluded online were the Consumer confirmed all the information provided. The digital acceptance of the Personal Loans was done electromagnetically and acts as the Consumer’s signature/acceptance”. Here the responder to the Banking Ombudsman stated that my two applications were digitally accepted, which I true but I no idea what she means by electromagnetically when she supposed to stated electronically. I believe is she actually read her response before she sent it to the Banking Ombudsman she probably would have picked up that error, but at this stage I even doubt she would have.

Over the past years I’ve been requesting to be issues a summons to appear in court but it just doesn’t get done. I’ve spoken to a legal representative and I will take FNB up for maladministration as they made changes to my employment information without consulting me and they need to answer why they claimed on the credit life insurance even though I was excluded from claiming on the benefit as a self employed person. In other words, they need to prove that they didn’t know I was self employed from day one as a banking client. Not to forget I called the ***** department at FNB at 11:57, the consultant who listened to me l transferred me to the FNB Life department and that consultant advised me that she’ll ask her line manager to call me. I requested the call back as urgent and it’s 15:00 and nobody called. Shows how good FNB is at dealing with issues.

Present me with the summons that I’ve been requesting for over a year. I’ll have the FAIS case manager subpoena to court as well as an FNB consultant who’s call recording will be played in the courtroom to set the matter straight. Tired of you guys ********* ways.

As expected, FNB didn't even bother to contact me. Just shows their willingness to attend to matters.
