Human dignity chop Shop and eviction
Sadly this particular bank doesn't deserve a star rating in fact this particular bank probably is a very very detrimental to the health and the future of the people of South Africa. Having complained about my situation to the banking ombudsman they said "we feel for you in this time but there is nothing they can do" Homeless was my sentence, without even the decency of knowing who I was in my primary residence and business. It's one thing to make a mistake or be in error but to know that despite my details and objections living in my home for 15 years means absolutely nothing. That months of correspondence resulted in sorry for your impending homelessness. Upon further and detailed investigation I discovered irregularities false affidavits and action approved by management at the bank, senior management that back up everything as detailed. Who am I to garner such high level confirmation of this position and none of these people came to verify who I was or am. Even during a global pandemic I had to and still am defending my home by myself from everyone - the bank, attorneys and the city of Johannesburg. They never once assisted or provided a solution for my issues. In terms of section of 36 of the constitution this is the invalid limiting of a person's rights to dignity and equality. This is the law and these folks are abusing the court system, such that my home was going unopposed for auction. I have a family of 15 years and history in my home. My blood sweat and tears to! This has to stop now. Should you be in the same situation or know anyone who is, contact me please! We don't get paid for this work but have to pay the attorney costs, which the bank is happy to spend and we the people can't afford a 60000 high court advocate deposit to engage equally. We are treated as defaulting **** even when we are not always responsible. Have you been advised and told about the insurance cover that's included and mandatory to cover you during hard times? They never tell you not are you advised to enforce it. This is the most despicable of banking organisations. Profiteering off your misery and property loss. Help to stop this Now!
Thanks very much for your response, I do appreciate it when there is feedback.
The key issue that is in focus, is that procedurally speaking, none of the correct processes were followed in this matter, including the exclusion of me in my primary residence.
The constitution and my rights were overlooked without any of the due processes included in my claim above being sought as primary remedy. As all are aware a sale in execution is meant to be the last resort.
But evidence I am this matter proves that none of the laws in terms of the NCA and CPA were followed and foreclosure was sought in a frivolous manner at my degradation and detrement.
I have not been able to afford high court representation or support in this matter and had to work this out myself, for which I have the cost of loss to earn a living whilst I learn the justice system.
It has been time consuming and a year later almost, having made payments to yourselves for an account that doesn't recognize me or my constitutional rights is reprehensible 25 years into our democracy.
I am not the only victim of expedience.
I forgot to mention that banks hold enough seats on the ombudsman board to ensure that impartiality is under threat.
This is even more shameful for my fellow South Africans, I would like to ensure that transparency and damages to others in these matters be rectified as they would perhaps have allowed the banking institutions and the ombudsman to brow beat them into submission.
How can firstrand bank report 34% increase in earnings during a pandemic when there are also allegations of ***** overseas.
I would like to draw reference to my statements in these matters that around 2 years ago when I appealed for assistance, I was sidelined and here I am again delivering for the benefit of all current and future customers, some things that just are not fair at all.
I constantly advise any I encounter using your banking services that you are all welcoming and helping in the front whilst ending lives in secret at the back.
All I ever asked for was the opportunity to be equal and that my right to equality be understood so that I may have the right to address these issues.
I was not considered and to date still not included. I was not allowed to receive these statements which were submitted to the court in support of financial duress by first national Bank to proceed with the high court action.
How can you allow this to happen?
