Highly Disappointed... Considering another bank.

I exMy personal loan account was handed over due to my being unable to meet the monthly financial obligation as I have been unemployed. I explained the situation to Broos & Luyt Attorneys and after much time, we seemed to have come to an understanding. We agreed that I would pay a certain amount that I could afford. I also explained why I could not increase the amount or make it any better.

In December 2016, I received an sms stating that summons was being issued. When I enquired, I was told that it was a computer error and that all the clients received it even though they have payment arrangements in place. I was told that they are correcting the error and that I would not receive summons.

On 3rd March 2017, I received a Combined Summons, dated 9th December 2016, stamped by the court 9th February 2017 and by the Civil court 28 February 2017. When I enquired why, it came across as standard procedure. I was told that my contacting Brooks & Luyt was me responding to the summons and that I didn't need to do anything further. I was also told that as long as I kept to my arrangements, Brooks & Luyt would not have to proceed further unless the client wanted that but that everything was okay thus far. The summons stated that even after demands I had not paid part of the account. So what are my payments?

I request for written acknowledgement on the 3rd of March 2017 and on a weekly basis but to date have received nothing. On 15th March 2017, I asked for the matter to be escalated to a manager. The manager tried to make me look as if I was at fault even after explaining myself in detail. Eventually, he agreed to give me something in writing vua email but would have to go through the recordings first. To date, nothing received. Yesterday, I received an sms saying that they would be approaching the court to request for judgement. When I called in, I was told that FNB had every right to do so and that the judge would say that I am not paying what the bank wants but how can I pay what FNB wants if I don't have that money? I have on countless occasions advised Brooks & Luyt of my financial situation but still they go this route. I was told that they act on behalf of FNB and in doing so, they are putting the good name of FNB to the dogs. I've been an FNB client since 2009 and never ever was I persuaded to change but this has left me wanting to do so.

My FNB overdraft account is with Blake and Associates and I don't have any issues with them nor do I have with my other creditors. Just Brooks & Luyt Attorneys.

I've always loved banking with FNB. I have always been a faithful proud client. For me, no other bank came closer to excellence but not anymore. I will never have anything good to say about the bank due to Brooks & Luyt attorneys and how they have handled the matter. I was also told that FNB cannot do anything about this matter because the account is with them and they act on behalf of FNB but I wanted to notify FNB because how many others are going through this and have no voice to speak because Brooks & Luyt aims to shut them up by making the client feel like they have no legal rights.

If I had the money to pay off my debt with FNB, would I be treated better? Would I be treated like I had rights?

Reviewer Update

Good day,

Thank you. After I lodged my complaint on Hello Peter, the Call Centre Manager from Brooks & Luyt resolved the issue in an excellent manner. I honestly felt like I would get no response from them and that is why I also advised FNB. I didn't expect a response from FNB either because that's how it came across from the consultants that once the account was with them they acted on your behalf and FNB could not intervene.

From the email response, the matter has been resolved. Please let me know if I should send through email confirmation of this.

Regards,
