Freezing my Business and Personal Account
JR Productions (PTY) LTD, an events company, went into a sponsorship agreement with Distell Limited for an event which was scheduled for the 28th October 2017. The agreed sponsorship funds were not received timeously before the event therefore personal funds were utilized in order to secure service providers. Once the sponsorship funds were received by JR Productions (PTY) LTD on the 28th October 2017, a few payments for services rendered were effected. On the 30th October 2017 JR Productions (PTY) LTD’s FNB Business Account was frozen together with both Directors’ FNB personal banking accounts on the basis of “suspected *****” reported to FNB by Distell Limited. A visit to FNB’s Sandton City branch was conducted on the same day where I was advised by Tina Sekete that Distell Limited had accused JR Productions (PTY) LTD of de*****ing them. Tina Sekete said that FNB would conduct their own investigation and that it was not yet necessary to open a Police Case or involve legal representation. JR Productions (PTY) LTD requested feedback from FNB on numerous occasions following this visit and were told that feedback would follow shortly. A second visit was made to FNB Sandton City on the 06th November 2017 where I met with Charles Nkosi, the branch manager, who reiterated what Tina had said without an attempt to further assist me although I had the supporting documents on hand. I was referred directly to FNB’s ***** division where I was to contact Heinrich Schempers on ********** . There have been numerous unsuccessful attempts to contact him to have this resolved. On the 07th November 2017 JR Productions (PTY) LTD’s FNB account as well as the Directors’ FNB personal accounts were unfrozen and funds were available. I then transferred funds to my Financial Manager’s personal FNB bank account in order for him to further effect payments for the said event. The following day: 08th November 2017 all accounts were frozen again, with no communication from FNB. My Financial Manager’s FNB personal account was also frozen on the 09th November 2017. This matter has resulted in the following grievances: - I have sustained a loss of income and profit - “Defamation of Character” – I have been degraded and defamed as an individual and business owner - Due to FNB’s inability to resolve this matter I have wasted essential time and incurred substantial costs in order to acquire legal advice - This accusation has not only affected my business but also affected me in my personal capacity in terms of providing for my family - This has also affected my credit status as my debit orders were dishonoured - If I was a ********* would I not have cleared out the account? - Why would I walk into an FNB branch if I am an alleged *********? - Why were the funds made available and then frozen again?
