FNB...........allowing people to get into debt
Just a warning about FNB loans. Make sure you read the fine print very carefully. There is a section that states: " Affordability Disclosure (Summary of your income/expenses) Under the National Credit Act 34 of 2005 ("NCA"), the Bank must assess if you can afford this credit agreement. To do this you agree that the Bank will rely on the information you gave to it or the information which you confirmed as correct when you app**** for this Loan. If you didn't give the Bank all the information it required or if you ****, withheld information or confirmed incorrect information, the Bank has a complete defence against an allegation of reckless credit. Summary of your income/ expenses that you declared to us as correct"
This was on my estranged husbands one loan agreement which was granted without my consent (March 2018). We are married in Community of Property, technically separated. Firstly, he **** about his expenses. FNB don't do credit checks for their VIP clients. Secondly, this particular contract clearly stated Married in Community of Property, yet my consent was not asked. The other loan taken out in September 2018 shows divorced as he changed the status. FNB don't take responsibility for reckless lending. This is a serious matter as my estranged husband is saying he has no money to pay maintenance, yet his various statements prove the opposite. Why did FNB not do a proper enquiry before granting high loans, revolving credit, credit cards, high over drafts etc. FNB was a top bank. Now it looks like Capitec is in that spot as they are super strict. Im disgusted. Next step.............Banking Ombudsman.
