FNB treating foreigners like second class citizens

Firstly, I am a South African permanent residence holder and I am married out of community of property according to the laws of my country (XYZ). I app**** for my bond with FNB and I indicated on my initial application that I am married out of community of property and my marriage is registered in my country (XYZ) hence governed by the laws of that country (XYZ). With all this information on my application form, FNB granted me a 100% bond. One-month later, FNB reversed the offer and told me that my marriage is foreign registered, and in their world, all foreign marriages are treated as married in community of property. They requested for my wife details who is unemployed and added her details on the bond to make it a joint application. Thereafter, I was told that I no longer qualify for the 100% bond but only 80% bond. The law is very clear on how foreign marriages are dealt with on conveyancing, please see the clause below which governs foreign marriages on property purchase by foreigners in SA: Treatment of foreign marriages when buying property in South Africa “Where the purchasing spouse purchases property and wishes to take a bond to pay the purchase price, the non-purchasing spouse will have to assist the purchasing spouse in taking the bond. Note that this does not mean that the non-purchasing spouse becomes a co-owner nor do they become liable under the bond. It means that the non-purchasing spouse signs documents to show s/he is aware the bond is being taken out” I appealed to FNB to review my application and grant me the full amount based on the following factors: • I am main banked FNB client • I do not have money for the deposit • I am a first-time home buyer • I have a good credit score • I have never defaulted on all the FNB products which I currently have (Motor vehicle finance, credit card, etc) • I have already incurred costs in paying the transfer attorneys No-one has bothered to assist me. To all those who have marriages registered in foreign countries, please take action now and move to other banks like ABSA which applies the above-mentioned principle on foreign marriages otherwise you risk being the next victim.
