FNB SLY ARE HIDING BEHIND BROOKES AND LUYTS

2008 Credit card account: Brookes and Luyts and First National Bank are making <br> <br> They started contacting me out of the blue since last year July (2017) Initially they were sms&apos;s saying "Christmas has come early 60% off if you pay now" and ie "this is your last chance for discount!" <br> Then in March the constant calling started where nobody talks. <br> Each day they come up with a new story.<br> No consistent response<br> <br> When a real live person did eventually talk each call agent has a different story. ie one person will say they are preparing summons for me. I have requested they email me this. It has been 10 days and no summons as yet. Another agent will then on the following call saying when will I start making payments? I have enquired as to why they have not once emailed me any statements from this 2007/8 credit card? They can give me no sensible reply... they did then send me accidently ...statements of another of their clients from Benoni...I pointed this out to them...this has not been rectified.<br> <br> I have received in 11yrs no statements, summons or Judgements from FNB or any other institution.<br> <br> Brookes Luyts phoned today and stated that there was a judgement against me from 2010. I did ask them why I was not warned/informed of this then? They can not answer me.(They have had my email address, as I have been outside the country a few years) If I had had a judgement surely I would not have receved residency in this other country. I have repeatedly contacted FNB to no avail.

So I do finally receive this 2010 Judgement, after weeks of asking for it I was told to contact Brookes and Luyts to conclude a repayment plan....But still no statements.... I still beg the question ...why was no attempt to contact me made on or before 2010? (I admit I had had my phone had been ****** and was basically homeless..living with friends and family) but I have always had this email address (that I managed to check periodically) which FNB has (they managed to contact me 7/8 yrs after the judgement on this very same email address)....on the judgement it states *The defendant was served (this is a blatant lie made by FNB!!) Now I ask about this? The Law says: "From 1 April 2014 there is no longer a need to apply for rescission of the judgement in Court. The listing will automatically be removed from one’s credit profile after 5 years without settling the debt. However it came to our attention that over the years at least 1 in 2 Judgments in South Africa was granted on ******* procedural grounds. This must be rescinded and removed from one’s credit record. When a judgment is found to be ******* or ********** the debt is no longer enforceable under that judgment. Why does this law exist? If large companies like FNB can simply over ride it? The amount has gone from 33789.99 to R100 000.00 You may ask why I am fighting this so vehemently? I am 54yrs old still unable to gain employ, the little I have I would like to retain. IHauger
