FNB SENDING ME FROM PILLAR TO POST ON MY POLICY

My policy with Law on call has lapsed after I had issues with my bank account on the night of 25 June.

I called Law on Call ***) on 26 June for a call that lasted 3 minutes. I called using ***.

I called again on 27 June and the call lasted 5 minutes 18 seconds. Using the same *** number.

On both occasions I was at pains to mention that I do not want this policy to lapse, because I have an active matter with attorneys.

I did everything on my power to ensure that FNB debits this account for two days running and I was assured that the debit will be effected. I even went on to ask for banking details so that I can make a manual payment but they made no provision for that. I was completely assured that my account was being tracked by FNB and a debit order will be effected. To my shock, I woke up to an sms on Friday 28 June that my policy had lapsed!!!

Yes in the past there were some unpaid debit orders but it is not in issue here, I was due to be double debited in any event and FNB gave me assurances that my account is being tracked and debit order will go off.

Following my initial complaint, On Wednesday 3 July I received an email from FNB insure telling me that the policy has indeed lapsed, I was advised to take up a new cover but assured that under the new cover my pre existing matter will be covered. I have a copy of this email. Once again FNB did not cover themselves in glory.

With that in mind the lawyers sent me my particulars of claim to go through, only for me to receive yet another email from FNB stating that this matter cannot proceed as my policy has lapsed. The information has been conflicting and detrimental to my case and mental well being.

I am involved in a massive defamation case where I am suing for R 500 000 and I have good prospects of success. I really do not wish for FNB to mess this one up for me.

I propose a settlement, I am happy to open a new policy and make sure that my premiums are up to date. Cover me on this current existing matter with a provision that under the new policy I shall make no claim for the next 12 months while I continue paying my premiums, alternatively please reinstate my policy so that I can continue with my matter.

Should this fail I will immediately approach the short term insurance ombud. But I wish to settle this matter amicably between FNB and myself.
