FNB QUICK SELL *****
My spouse and I are in the process of acquiring a Quick Sell property; and on the day the transfer was getting lodged FNB realised they had sold a house of a deceased man of over a year - This realisation was made on the 30th of August 2021, approximately 8 Months after accepting my offer and awarding our bond etc.
Since the mentioned date FNB have not mentioned any concrete answers as to how this will be resolved.
On the 7th of September I received an email from FNB's appointed transferring Attorney's stating the following:
"We received feedback from the Bank:
‘’It is the Executor and the Master that has to accept the sale. Until they have accepted it in writing, there is no guarantees. We have motivated that this sale be accepted.’’
Kindly advise if you are willing to wait as this process can be lengthy.
We await your response herein."
After putting a lot of time, money and effort into meeting the bond conditions and making slight improvements to the property & obtaining approved plans we have decided to wait for FNB to rectify this issue. Additionally, it is also easy for FNB to try to get me to back out of the deal to ease their task - Which I will not.
Bear in mind that the error/ ***** and negligence we are dealing with is one of FNB; however FNB refuses to be accountable - Dante Fogolin does not respond to emails, the bond consultant, my banker, appointed attorneys by FNB say it is out of their direct control - My question is who is in direct control of this matter? It is sad to see that accountability and communication is non-existent to FNB.
FNB and all related parties should expedite the process in acquiring the signature of the executor and the Master. Once the executor's signature is acquired, the Master should not have any issues with accepting the sale - As it is mentioned that the sale was motivated.
Furthermore, seeing that the property was initially a sale in execution (refer to reasons) and the fact that the deceased estate is insolvent, according to FNB, I don't foresee any challenges in obtaining the executors signature.
I want this issue resolved and the property transferred, and I would appreciate a daily update on the matter and not a generic update - This is my fourth complaint/ escalation.
