FNB POOR SERVICE
Good day,
I hereby wish to lay complaint against First National Bank, most especially Mr Phillip Hlongwane from the deceased estate department as well as the cancellations department.
Upon the passing away of Mrs Reddy we requested claim letters from FNB which we had received.
There was a current bond for account number 62****** which the bank claimed had a balance of over R750 000.00 as well as a previous bond for an outstanding balance of around R630 000.00.
There was a sale of immoveable property taking place to settle some of the debts of the estate and when cancelation figures were requested from FNB for the bond under account number 62***XX the figure which was given to the cancellation attorneys was significantly less than the amount outstanding by at least R140 000.00.
The guarantee was issued on this lesser figure as well and when same was queried with FNB to ask why the figure was so much lower the bank had not responded.
The transfer went through on the 29th of July 2020 and the bank was paid as per the guarantee issued.
A few days later the deceased estates department lodged a letter claiming short payment of the bond.
I requested an attorney to assist me in querying this with the bank as the amount paid was as per the cancelation figure issued.
Despite this query and supplying copied of the guarantee and the purchase and sale agreement Mr Hlongwane refused to give answers on why the cancellation figure issued was not as per the outstanding balance on the bond.
Instead he threated legal action against the deceased estate and the attorney assisting me because we dared to ask for answers on FNB’s behaviour.
We have now been forced to pay the shortfall under threat of legal action by FNB when in fact FNB will not give us answers on why they did not request the correct cancellation figure. The figure submitted was based on the previous bond and not the current bond which was an obvious error on there part that they refused to acknowledge and take responsibly for.
The money paid from the estate has set back the funds available to make payment to SARS as well as other creditors of the estate.
