FNB ***** - NO ACTION OR HELP

Dear FNB Team, I am writing to express my extreme dissatisfaction and frustration with the way my ***** dispute has been handled. I have submitted all documentation required to prove that the transaction in question was *****ulent, including: • The SAPS theft case number, and • The ***** case numbers issued for this incident. Despite providing every piece of evidence requested—evidence that is more than sufficient for FNB to act—it has taken three days for FNB to inform me that the funds “cannot be refunded.” This delay is unacceptable, especially considering the seriousness of the matter and the clear proof provided from the very beginning. I have been ******, and instead of support and urgency from my bank, I have been met with delays and a refusal to assist. Should the money be moved further or should I ultimately not recover my funds, I will hold FNB fully accountable for failing to act when all necessary proof was already in your possession. I expect immediate escalation and a thorough review of this case.

This situation has caused immense distress, and I need FNB to take responsibility and resolve this matter urgently. AFTER ALMOST A MONTH THE FNB ***** DIVISION STILL HAS NOT ASSISTED

Please be advised that First National Bank (FNB) has followed all internal processes to investigate your case thoroughly. FNB is unable to provide the requested information without receipt of a Section 205 subpoena.

Should you wish to pursue this matter further through ******** proceedings, FNB is committed to cooperating with law enforcement. We will provide the South African Police Service (SAPS) or other relevant authorities with information regarding the implicated FNB account, upon receipt of a Section 205 Subpoena in terms of the ******** Procedure Act 51 of 1977.

We regret any inconvenience this matter may have caused and appreciate your understanding.

I note the contents of your response. However, your position is both concerning and inaccurate in light of the current facts. Please be advised that the South African Police Service (Malvern SAPS) has already submitted the Section 205 subpoena in terms of the ******** Procedure Act 51 of 1977. FNB is therefore not awaiting a Section 205; rather, the police are awaiting FNB’s response, which has not been forthcoming. This continued delay by FNB is actively obstructing the progress of the ******** investigation. At the time of the *****ulent transaction, the funds were present in thier account, yet FNB failed to take immediate preventative action, including freezing the implicated account pending investigation. This failure allowed unauthorised parties to walk free with my money. Such inaction raises serious concerns regarding FNB’s duty of care, ***** mitigation controls, and adherence to standard banking practice in confirmed ***** matters. I am extremely distressed by the handling of this matter. I comp**** fully and timeously with all requirements placed upon me and provided sufficient proof from the outset. Despite this, FNB neither acted urgently nor implemented basic safeguards to prevent further prejudice. For clarity and record purposes, I require urgent written confirmation of the following:
  1. The status of FNB’s response to the already‑submitted Section 205 subpoena
  2. Confirmation of engagement and formal feedback provided to Malvern SAPS
  3. An explanation as to why the implicated account was not frozen when FNB was alerted to the *****
  4. FNB’s formal position regarding liability for the unrecovered funds
Should my funds not be recovered as a direct result of FNB’s failure to act timeously and responsibly, I will hold FNB fully liable for the loss. I also reserve all my rights to escalate this matter to senior management, regulatory authorities, and to pursue further legal remedies without further notice. Your response to this matter is now overdue. I expect urgent engagement and a substantive written response.
