FNB - How Can We Not Help You

Two efforts at trying to resolve this issue have already failed but perhaps third time’s a charm, right?

My spouse and I are in the process of acquiring a Quick Sell property, after a long road of constant back and fourth, complaints and patience the Attorneys, instructed by FNB, finally contacted us at roughly 10:00am on the 30th of August 2021 - stating the following:

“This is to confirm that we received our proceed to lodge from FNB and we are now ready to lodge the bond. We will in the interim instruct our correspondent in JHB to proceed with lodgement once all parties are ready to lodge. We will confirm once lodgement has taken place.”

At roughly 2:30pm on the 30th of August 2021 the same Attorneys contact us and mention the following:

“We confirm that FNB has informed us that the seller has passed away and that we cannot proceed with the registration of the transfer as yet. We must pend the matter until further instruction. We will keep you informed.”

According to the Home Affairs ID Verification Portal the above mentioned individuals deceased date is the 2nd of August 2020. Furthermore, the Offer to Purchase was accepted by FNB in February 2021 - roughly over half a year after the demise of the above mentioned individual.

Ironically, at my own cost — As per conditions of the bond, I have obtained the Electrical Certificate, obtained the Building Plans and made the correct amendments, obtained Approval for the Building Plans. Just for FNB to put the lodgement process on hold until further instruction? For what exact reason? As the above mentioned individual has passed away more than over a year ago.

According to my Offer to Purchase and Contract, FNB Quick Sell is in breach of contract - in which, I assume legal action would be the only way to move forward or rectify this.

Initially, Bond Approval was an issue. Then, there was an issue with the Bond Amounts, Bond type and Conditions - Now, it is this. I am honestly just tired of FNB and I am honestly having a hard time trying to articulate my despondency to continue banking with FNB.
