FNB Allowing Retention of Funds Paid in Error – No Meaningful Assistance

I am raising serious concern regarding how FNB has handled a payment made in error into an incorrect account.

A reversal request was submitted immediately, and FNB confirmed that the recipient was contacted. However, the recipient refused to provide consent, and the case has now been closed as unsuccessful.

While I understand that consent is required to reverse funds, FNB is now aware that this was an erroneous payment and that the recipient is retaining funds to which they are not legally entitled.

What is concerning is that beyond requesting consent, there appears to be no further meaningful intervention or assistance provided. It cannot be acceptable that once the bank is aware of an incorrect payment, the matter simply ends because the recipient refuses.

I would like clarity on what reasonable steps FNB takes in situations where it is aware of unjust enrichment, and how clients are protected in such cases.

I am currently pursuing further legal processes to recover the funds, however I expect the bank to provide clearer guidance and support beyond a single failed consent request.

This matter requires urgent escalation and review.

Title: FNB Final Response on Incorrect Payment – No Resolution Provided

I am posting a follow-up regarding my previous complaint about an erroneous payment made into an incorrect FNB account.

FNB has now issued a formal response confirming that the reversal was unsuccessful due to lack of consent from the recipient. They have also confirmed that they are unable to place any hold or restriction on the account and that no further assistance will be provided.

This effectively leaves me in a position where the bank is aware that funds were paid in error and are being retained by a recipient with no legal entitlement, yet no further meaningful intervention is taken.

I find this particularly concerning, as it appears that once a recipient refuses consent, the matter is effectively closed, regardless of the circumstances.

I have now escalated this matter further by submitting a PAIA request to obtain the recipient’s details and lodging a complaint with the Ombudsman.

I would like FNB to clarify whether any additional internal escalation or intervention is possible in situations where the bank is aware of unjust enrichment.
