Debt Prescribed Requesting Account Removal

I am requesting the immediate removal of the outstanding amount reflected on my FNB cheque account. No payment has been made on this account for over six years, and there has been no written acknowledgement of the debt nor any court judgment obtained against me.

In terms of the Prescription Act 68 of 1969, specifically Sections 10, 11(d), and 12, an ordinary debt prescribes after three years from the date it became due, provided there has been no payment, acknowledgement, or legal action interrupting prescription. Once prescription has run its course, the debt is extinguished and is no longer legally enforceable.

Furthermore, Section 126B of the National Credit Act 34 of 2005 prohibits a credit provider or its agent from collecting on a prescribed debt. Continuing to reflect or attempt to collect such an amount would therefore be ********.

Kindly confirm in writing that the amount will be removed from my cheque account and that any internal or external records will be updated accordingly.
