Contract breached - unfair repudiation
I refer to a claim with reference LC***:CL324114.
This policy started through an unsolicited direct marketing call, with the caller fully aware that they were calling a representative of a Non-Profit Organisation. The policy became in force on the 20 May 2022.
As alluded to above, we were sold this policy with the understanding that we are a non-profit organisation. We kept the policy in force and paid all premiums for 4 years. When we claimed last week we were informed that the terms and conditions of the policy have changed and NPOs are no longer covered. Either that, or we were sold a policy that did not apply to use, which constitutes unfair treatment.
Please note that this claim was repudiated based on new terms and conditions that were not communicated with us. You had a duty to inform us of any material changes to their policy, and failure to do so has invalidated your reliance on those new terms to deny our claim. The recourse we seek is a refund of all premiums paid to date and a cancellation of the policy. Account number: ***
