Concerns Regarding Child Maintenance Case – ***

Dear FNB Law Call,

I am writing in connection with the ongoing child maintenance proceedings (***).

I wish to raise serious concerns regarding the handling of my case and the depletion of funds from my policy without meaningful progress. Specifically:

1. Audit of Claims: Are audits conducted against Law on Call claims? My funds are being depleted, yet the case appears to be going in circles without resolution.

1. Lawyer Allocation: I have been allocated to different lawyers without proper handover. As a result, I have had to bring each new lawyer up to speed, and some of the monies claimed were for this duplication of effort.

1. Unfulfilled Promises: ◦ Execution of the defendant’s suits was promised so that funds could be secured for the child’s needs. ◦ A ******** case was to be lodged concurrently with the child maintenance matter. ◦ I was assured that funds would be used sparingly until the conclusion of the case. Instead, I see claims that do not add up, including repeated trips to the Sheriff.

1. Court File Management: Each time we attend court, the file is not included in the roll call pack. We are forced to wait until 11:00 or later for the file. Who bears responsibility for ensuring the file is ready on the court day?

1. Investigation Report: Since February 2023, we have been waiting for the investigation report concerning the defendant’s church remuneration. This report is critical to a fair resolution of the matter. Who is responsible for ensuring the investigator completes this work?

Given the above, I request clear accountability and transparency regarding: • The auditing of claims, • The management of case files, • The delivery of promised actions, and • The completion of the investigation report.

I trust you will provide clarity and corrective action to ensure that this matter is resolved efficiently and in the best interests of the child.
