Hello Peter I took out an overdraft of R30 000 with FNB for my business with a surity of R30 000 investment. After a while the business didn't do well but l periodically paid R1000 from my personal reserves. Payments became unsustainable. On Saturday 30th of June 2018 FNB unilaterally took a third of my salary from my personal account. On inquiry on the 2nd July 2018 l was told by Nkosinathi Khuzwayo from recoveries that he personally took the funds and refused to release them or negotiate on affordable terms. He was arrogant and very condescending. He refused to do an affordability assessment even though l pleaded desperately. I kept reminding him that he was taking a third of what l earn. He just said that l got myself into this trouble and have been unreachable. I asked why he was coming into my personal funds whereas there is an investment surity in place. He blatantly refused to hear me out and I left the FNB branch feeling defeated. He left me in a situation where l had to beg people for money having no idea how l was gonna pick up the pieces. I would like to know if what he did on behalf of FNB was legal. What recourse do I have?
