Bank Charges - Debt Review Not Implemented for 20 Months after being approved in Court

After a change in financial circumstances beyond my control I was forced to go under Debt Review with a registered Dent Review Agency to ensure that my creditors were paid.

Court order was approved and all debt serviced faithfully according to the restructure. Never missed a payment or paid late.

FNB took 20 months to reassign the overdraft amount in my current account after the agreed payment arrangement was made legal. I did not transact on the current account during this time at all. I recently got a letter from the Legal Department telling me they had restructured my debt and I was now responsible for account admin fees going back 20 months.

How can you not empower me to close the account (which is a legal condition) because of your delay in following a court order and then hold me responsible for backdated bank charges of over R 4000-00. I will be contacting the Banking Ombudsman as this is unacceptable and I believe *********.

Good Day Cherelle Smith Your email to me dated 6 May 2019 does not answer my one query. I am trying to resolve my issue regarding the bank charges on my current account with FNB. I am not disputing my overdraft debt and have been faithfully repaying the debt review mandated amount every month since 2017. I was instructed by my Debt Review Advisor to immediately open a savings account and to use this for transactions which I duly did, additionally as soon as the overdraft was moved to a loan account I was to close the current account. As explained I was unable to do as FNB did not remove the overdraft balance into a loan account until March 2019. My problem lies with the fact that FNB are not prepared to acknowledge that this account could not be closed as the balance of the overdraft debt was only transferred out of the bank account by their staff in March 2019. I had no control over whether to close and not incur bank charges or not. What recourse do I now have, as I do not have the R3117-77 to simply settle and close this account which is as we speak racking up more fees every month. I am a responsible adult and have serviced my debt faithfully as well as having been an FNB client for more than 20 years. Your response to me via email today did in no way acknowledge how long FNB has taken to review this debt - 21 Months to be exact.
