Bab experience with Law on Call - Mmabatho Chiloane
I had a very odd engagement and interaction with FNB’s Legal Advisor, Mmabatho Chiloane regarding a dispute I have with one of the Car Dealers.
(1) Firstly, the very first engagement with her pointed out to a pre-determined outcome in terms how my claim would go, and this is why I am saying this: firstly, she urged the business model of this car dealer, that they sell voetstoots, without first looking at the merit of the case. I had to kind of defend against her line of argument as if I am in court and she is the judge - remember I am seeking help in terms of the Law on call insurance I have been paying for over 10 years, and I have been a loyal FNB client for over 15 years.
(2) Her second argument arose when I indicated the car is financed through Wesbank, and she said Wesbank cannot be brought into the case because it will be conflict of interest. I agreed to this. Indeed, the case is between me and the dealer and the correction they have to make on the car, and it has nothing to do with Wesbank. Mentioning this was the beginning of my nightmare.
(3) Thirdly, she gave me a call yesterday after I have made my submission, and she is agreeing with the outcome (report) of the car dealer, and asked me if I have taken their advice, saying that I am given a legitimate advise by the same people I complaining about - this is a wow. This is a clear indication of bias in favour of the car dealer (looking at my point number 1 above). Also legitimizing the car dealer’s report also shows the biasness. I had to personally defend myself before her. On the Call she made to me, she indicated that my claim was rejected because the car is financed by Wesbank. Let me reiterate this: this case is between me and the car dealer, and has nothing to do with Wesbank. Mmabatho Chiloane argues that Wesbank is essentially the owner of the car (listen to your recording) – If this is the case, why are they not fighting this battle then because this is their car?
My conclusion here is that Mmabatho Chiloane influenced this claim in favour of the car dealer, whilst a loyal client of FNB, who has been paying Law on Call insurance for may years is left in the cold.
To FNB law on call – Do you mean: if I have a dispute a the contractor working in my house financed by FNB, the issue cannot be covered by Law on Call even though it has nothing to do with FNB. Do you mean that if I get into an accident with a car financed by wesbank and then this results in a litigation, you will not cover that if though FNB is not a subject matter? If this is the case, you must tell the clients whom their lives revolve around FNB and its sister companies. I find this to be extremely problematic.
