3rd Party

Hie..I need help. I was involved in accident on the 3rd of October 2020 in Florida, Johannesburg. I had the right of way and the other car coming from Rhodes street did not adhere to the stop sign and just came in front of me and we collided. Within no time Fist Help guys came to the sport. The lady driving the other car is insured by 1st for Women and am not insured. She agreed that she was wrong and did apologies she said she thinking a lot and she thought it was a 4 way stop. I was told that her insurance wants both cars for assessment, i wanted to take my car to my place because I stay in the area but the First Help guys said to me the cars must be towed to one place and her insurance has already issued a reference number of which I was given that refence number. The cars were both taken and I went to the hospital because we had a baby on board so the ambulance had rushed him to the hospital. We did exchange details. Her insurance called me a later was given 3rd party claim reference and later on legal team also called me confirming details.

Now the problem I am facing is First Help sent me an invoice for R22000 and they i can pay the money and take my car then take the invoice to 1st for Women coz they are the ones who must pay. I don't have the money, I the forwarded the invoice to 1st for Women. This is how they calculated : In order to resolve this matter amicably and to avoid incurring unnecessary legal costs, we are prepared to make an offer of R 3,180.87 towards your client’s damages, which is tantamount to a 90%:10% apportionment. Calculations as follows: Third party damages: R12,994.43 x 90% = R11694.98 Client damages: R85141.20 x 10% = R8514.12 A less B: R11694.98 – R8514.12 = R3180.87 The company doing this on behalf of 1st for Women Insurance is called Telesure Investment Group. If I ask them what will happen to my car the answer I am being told is that I must first sign the release form for R3180.87 then they will discuss about it after I have signed. The other thing they say I agreed to be paid money in order to find my own mechanic of which I never did and they themselves don't have proof that I said so. I was sent a letter from lawyers demading R59 000 for damages for the other car. The letter has wrong details, according to the letter the accident happened in Midrand yet it happened in Florida but correct reference number. I asked the lady I was involved in an accident she said she knows nothing about the letter maybe its her insurance. As of now I have not signed the release form.
