Not honoring contract

I Took out an insurance contract on my iPhone 6S 128GB in 2016 to replace if ****** or lost and for repairs.

The contract stated to replace the device if it was not proven to be neglegence.

They are now backing out saying the iphone has been discontinued and lost value so they will pay me out a portion of the value.

Any other reasonable insurance company, be it for a TV or whatever, gives you the same replacement device or if that specific device is not avialble anymore they give you a better device.

I want them to replace my iPhone 6S 128GB as we agreed when I took th epolicy.

I sent the device in for repairs some time after taking the policy. I waited for some time before I was given a call to pay some outrages excess amount. They said its because I did not take out th einsurance immediately when i received the new handset.
None of this was mentioned in the phone activated contract. I had a drawn out email fight for a few months and asking for the voice recording to prove those conditions were discussed. Nothing. Then they agreed the actual discussed excess amount, which I immediately paid. Only AFTER I paid money over did they come with all stories of suppliers not having stock of my iPhone 6S 128GB handset and they would be prepared to give me a Samsung S6 or some other cheapy handset.
I checked and found suppliers like iStore with stock of the devices. When I informed they they said they dont deal with iStore. I then gave up the fight after 7 months of still paying my contracted amount for an iPhone I did not have and their insurance premuim, and said I would accept one of the other devices. Then we went back to the loop of their management having to approve it and still after two weeks not a peep. In short the time scale goes:

a. 15 September 2016, Hand my phone in at Cell C Eastrand Mall for repairs to a cracked screen.

b. 30 November - After having no feedback and contacting CellC via FB chat, they refered me to lease with Nancy at Finrite.

c. 1 December - fighting about the excess fee of R7000 which was never discussed. I request the voice recording.

d. 5 December - after another request about what's happening, I get informed the voice recording was requested and takes 7 days to be delivered.

e. No contact after numerous emails.

f. 8 March 2017. I resend my claim to Natasha at Finrite. The entire loop restarts.

g. 11-13 March. again after rejecting the R7000 excess, the voice recordings are requested and we have to wait 7 days. No response or no copy of the voice recordings. available handsets. they dont care where you can find them. If they say its not available, its not available.

h. 22 March. Still waiting for managent to approve since the 12th.

i. 27 March still nothing.

30 March and Finrite are still trying various tactics to avoid honoring the contract. Voice recordings have not been delivered. now they are referring to policy documents that were supposed to have been delivered via email. Well I never received anything. Their Exchange server can easily produce logs to verify the email was delivered. Please produce the logs.

31 March. I never received any policy from them via email or any other way. They should be able to pull logs to prove that. This is the third time today they informed me the voice recordings will be requested. So what happened the previous two instances they said the voice recording is being requested. Were they just lying? that would not surprise me in the least.

It now is 17 April. Still no movement to honor their contract after taking my money and still diligently taking my money every month....
I wonder how these people look their children in the eyes and teach them about honor and respect?

we are starting to approach the time it takes women to produce an entire human being. Finrite has not been able to honor a contract they made with me. They have been successful in taking my monthly subscription though.... :-(

12 May. Still no result from Finrite. They have used my excess money to buy samoosas and run away with my iPhone.
Their service stinks.
I have been paying my subscription for my handset every month, plus insurance on that handset that I don't have, and iTunes services that are loaded on that handset. My loss thus far amounts to R8,246.07 .
