Finn Auto Port Elizabeth

I have bought a car from a second hand dealer, however within the first month the gearbox gave problems we complained was told we bought it voetstoots. Low and behold 6 months later the gearbox packed up. Took it to Finn Auto got a quote for R26000 for a second hand complete gearbox. Whilst there they actually bumped the front of the car. After figting with them they wanted to buy the car for R50k and i was told that insurance said it has to be written off. After investigation and speaking to their insurance i found out the cost of repairing the bodywork is R16k and writing off the car was never discussed. The car has now been with them going into its third month, they keep on telling me about the mechatronics and the chip was send to cape town 4 times now. Mind you we were quoted seperate for this initially R11k and then they came down to R6.5k. When i emailed the owner and told them that their stories does not add up as why would a complete gearbox that was quoted suddenly not working with mechanics as it should come with rhe part the owner had another story. I asked them numerous times if the gearbox they bought was a dud then rather take out gearbox and refund me to no avail. I have emailed them trying to resolve to jo avail. We had to pay upfront for this. I found out that the owner is the regional head of RMI. The loan car with 300 000km on the clock left me stranded twice. They were on their annual break no emergency contact number i had to phone their insurance to contact them. What can i do i am at my wits end. I am resolving to go to small claims court and the motor industry ombudsman. The consumer tribunal takes to long. They are contravening so many CPA acts etc.

Mechatronics is the electronic side, not the mechanical side of the gearbox, 2 separate issues.  No act stipulates a time frame, as long as we persevere to fix the car.  We did our utmost to accommodate customer, it's in our best interest to be honest & do what we are paid for. The car fixed & gone.
