Faircape abusing their power as managing agents

<p>I received a warning for not cleaning up after my dog a year ago when a family member was housesitting for me. I was overseas at the time But contacted the family member to clean the balcony immediately. 5 months later I was issued with a R500 fine without any warning when it clearly states in the rules and regulations that you have three days the remedy the complaint. I clean up after my dog on a daily basis but in this event, due to my work schedule, it was cleaned late that evening. I paid the fine to avoid conflict and continued as normal (cleaning on a daily basis). 6 months later I was issued with another R500 fine (added directly onto my levies statement) again without warning on another busy work day (which was cleaned up that evening). Again without the three days to remedy the complaint. When I queried this, I was issued with a warning for having my mop on the balcony (which I removed immediately) as well as a photograph of my balcony which is bordering invasion of my privacy! <br /> <br />When I tried to call Faircape to find a reasonable solution and to dispute these unfair fines, the response I got was "sorry this came directly from a member of the board, it's out of our hands" (this was after multiple failed attempts to get hold of someone). I was dealing with Halemah Ismail and she directed me to Lynn Jacobs. I tried emailing her to which I got no responses. I emailed again a third time to which her response was, you can call me on my cell, I'm available today. When I called her, she said she was busy in a meeting and that she'd call me back. Two days later when I didn't hear back from her, I called her again. She said she'd present my case to the board of trustees and I don't hear from her again. I then receive my levies statement with the R500 fine. I called her again and her response was, "pay the fine as we cannot revoke the fine as it sets a bad precedence for the rest of the residences but just state in an email that you are in no way admitting guilt". What precedence does this set exactly?<br /> <br /> <br />I would understand if these complaints were on a daily/weekly basis, but these are sudden fines in almost half year increments.<br /> <br />Faircape have been very dismissive and are abusing their power as managing agents of the complex.<br /> <br />Is there somewhere I can go to take this further (as I'm seriously considering it)? Their non responses are just making me angrier and angrier. As a homeowner, I just want to find a reasonable solution and to avoid getting another unfair fine 6 months down the line.<br /> <br />I have not had a great experience dealing with Faircape! (Even when I was renting through them a few years back) #nothappy!</p>
