Bad experience I had with rent to own car dealer namely Executive Motors in Bloemfontein

I once sent a review about Executive Motors in Bloemfontein and I never got a response from them. I have decided to keep on writing a review about my heartbreaking experience with this business until I get answers from them as well as to encourage others to read car contracts carefully, question unclear clauses on contract and to keep on fighting for their rights as consumers.. The incident happened few years ago when the car I rented to buy from Executive Motors was involved in an accident when I was trying to avoid a huge pothole on the road. Unfortunately I bumped into the car which was parked on the side of the road and the airbags of my car explodes and the car was written off even though it had minor body damages on the front left part. This happened on the 49th month of using the car which got stuck multiple times during this period and I paid over R26 000 in repairs out of my pocket and I still have all the invoices for such repairs whuch I reported to the dealer each time.

My complain is about the following:

1. I have been asking for clarity regarding a clause on the contract which reads as follows; " At the end of the contract agreement, the client must return the car being in good condition to the car dealer's office before the end of their office closing time." My question was that " How can I bring the car back when it was said to be a rent to own car? " I was then assured that the car will be legally mine after the 54th month. I asked that I be given this assurance in written contract that at the end of the payment period the car will belong to me which was done but only after three months of driving their car. 2. After being given a document which confirms that indeed the car will be sold to me at a 0% which was signed by the CEO of the company, I realised that the period of car payments will be 48months contrary to the initial contract I signed which has 54months. I made the company aware about the differing dates of last car payments and end of contract date on initial agreement but I was told that the car I was driving was on 48months as all cars rented after 2015 are on 48 months period and not 54months hence I was given a confirming letter of 48months. I even contacted them on the 46th month to make them aware that changes and promises on contracts as per changes made by them will be ending in two months and I was assured still that the car will be mine thereafter. 3. Unfortunately on the 49th month which according to the document given to me, the car was paid up and legally mine but still insured with their insurance company which they promised to terminate after the 48th month so that I can get my own insurance but when I was involved in an accident at the end of 49th month, they insurance money was paid to Executive Motors and the car installments continued even though it was paid up. My attorney had to intervene by contacting them to make them aware that the car is paid up and that was when they terminate the debit order at the end of 52months. They promised to refund me the four instalments and the insurance money but they never did. I got a second attorney who fought for the insurance money and four instalments but to date no payments have been made to me and sadly I am still without a car since then as I am still fighting to be paid which is not happening and am not giving up.
