Irresponsible Credit Practice
I am married in community of property. In terms of the Act, either myself or my spouse is required to obtained conscent before any credit agreement can be entered into. To clarify, no spousal approval was obtained to open an account or go into a credit agreement with TFG.
After *******ly providing credit without spousal approval (community of property) TFG then sights the POPI Act to prevent a spouse from obtaining any information about the debt incurred. This means that even though a spouse did not agree with the debt, TFG can hold that non conscenting spouse liable for the debt, but that spouse is not entitled to enquirer about the debt.
Further more, monthly they will contact the account holder for non payment (credit the spouse knows nothing about). If the account holder then makes payments TFG will continue to increase the credit limit Automatically (also not requested). If an account holder has demonstrated difficult in paying the account consistently why provide more credit?
To make matters worse, when I brought these lending practices to the attention of TFG, they showed no interest, accept to confirm that the non-conscenting spouse will also be liable for the debt incurred. And the wording of automatic credit increases (not agreed to) relates to TFG obtaining permission to extend your credit beyond R25 000 without approval from the credit bureau i.e. it’s got nothing to do with an account holder not wanting a credit increase.
