given a damaged car

my mother was given a car with cracked windscreen. it was noted on the checklist of the car. first time when I drove the car was when I returned it. cracked screen couldn't be explained, cannot get hold of my mother. get home. my mother confirmed that its an old thing. telephonic update to the europecar agent who took the car. he said he will sort it out. now I have been taken to the lawyers to be blacklisted. 1. all europcar agent when they call I give them the same story but no one comes back with copy of checklist of the car 2. the same law firm i explained the same story. just like Europe Car agent they phone and send u the sms that you will be black listed 3. why am I paying for a car that came damaged?
