**** charges in Durban, Europcar can't prove debt claims when requested

I rented a car from Europcar on Sept 1, 2016 at OR Tambo and returned it on Sept 14, 2016 to King Shaka Airport in Durban. The contract was ********** 14. When I picked up the car there were problems with the Europcar staff, so no one was available to check the car, so the initial car damage report was unsigned by both me and the Europcar representative. I returned the car just as I was given it, but the check-in representative in Durban named Ziphokuhle was looking to scheme us.

Ziphokuhle immediately started making up claims about the car, and they were so ridiculous we asked for a manager. He refused, so we took pictures of him standing and pointing to all the alleged “damage.” I have very high resolution photos showing that there was not a single scratch or dent anywhere, and all my photos are time-stamped and geo-tagged to show that the car was at Europcar in perfect condition.

Ziphokuhle insisted we sign a form accepting responsibility for this invisible, make-believe “damage,” and we refused because the form admitted to fault when we were not at fault as clearly demonstrated by the lack of visible damage. It was so ridiculous I felt like I was in a Twilight Zone episode, as Ziphokuhle pointed to absolutely nothing and claimed he saw something. It was so obvious he just needed to claim something, probably under threats from his management to increase revenue for the branch. To get revenge on us not admiting to his invisible claims, Ziphokuhle filed several false claims, totally nearly 11,000 rands worth of false claims, which more than doubled the cost of the pre-paid rental car. We contacted our credit card who had their lawyers contact Europcar demanding proof of damage, which was never sent by Europcar.

Some of the false charges include the false damage claims as well as false claims that the car required additional petrol. I also have receipts showing that I filled the car at the on-site petrol station and can prove exactly how many litres I put into the tank at the airport location. Clearly Ziphokuhle is doing some serious *****.

I recently received a demand letter that is threatening me if I do not pay all these false charges. I will happily take this case to court because I have all the evidence proving that Europcar never documented the initial state of the car, photos proving the state of the car upon return, receipts showing the petrol levels in the tank. I look forward to you not only clearing this debt but explaining to me how Ziphokuhle from your King Shaka Durban location will be punished for his ********** claims.

It's been a week and I have received no further comments from Europcar. I have also been corresponding with Europcar's international customer service, but they have ignored my last 3 emails and also have not responded in a week. Europcar's email customer service also does not sign their emails so I have no names of representatives, which seems quite unprofessional.
