Eskom KZN: Exploiting Emerging Contractors

I had a contract with Eskom KZN since August 2019 to July 2022 and it was extended to July 2023 ( PPU Audits, contract no: ***). I did and completed work as per the contract and submitted invoices and was paid for a portion of work however during the contract period there were contractual issues (rates vs activities as per the scope) as a result a meeting was held with management on the 30th October 2020 and a resolution was taken that since the contract cannot be amended alternatively we can use a separate contract (maintenence contract: ***) since its rates had the correct rates for the scope of works however only contractors who were on both contracts at that particular time were permitted to continue working and claim using the correct rates of maintenence contract. My company (Mboyisa Projects) and Ukunqoba Distributors were the only two contractors. Both contractors continue with work, Ukunqoba Distributors was allowed to claim and was paid accordingly however Mboyisa Projects submitted an invoice for the work done and completed but didn't get paid. An invoice of R5 186 691,60 was submitted but have not been paid to date. I have engaged Eskom several times through emails, phone calls and even went as far approaching legal assistance but still we didn't win, ence this review.

Through bank repossession, I have lost everything, my business, my property, my assets. I have enemies due to unpaid salaries for employees. I have debts, including update legal fees and my life is a complete mess. I'm currently unemployed.

Eskom KZN is exploiting emerging contractors as a result many contractors have collapsed and closed down, resulting to many people unemployed.
