Engel & Volkers outdated leases

Engel and Volkers in Campsbay did the lease with the landlord of the apartment I rented in Greenpoint Cape Town. When I moved out, as the apartment was sold, the landlord kept my deposit as he wants to backcharge me the electricity box charges he gets charged from the City of Cape Town as part of his rates account. I got legal advice and its *******, while Engel & Volkers's, Lynn Barrie who was initially very slack, their legal team says its valid although there is NO mention of this in the lease. I am now taking the landlord and Engel & Volkers to the WC Rental Housing Tribunal but nothing protects tenants from scrupulous landlords and agents. I am very disappointed in E&V being such a reputable agency. Their lease is outdated has all the responsibilities of the tenant but none of the landlord in their lease. Be very careful when dealing with Engel Volkers!!!

The tenant signed a lease with a clause clearly stating that he is responsible for meter charges.The landlord wants to claim the meter charges from him & this is a dispute between the 2 parties.This is not a managed lease, however we have done our best to assist & can only mediate.

This is disappointing and I will then continue with the matter at the WC Rental Tribunal with Engel and Volkers and the landlord. Engel & Volkers surely cant dissolve themselves of responsibilities ito the lease even though this was not a managed lease, its what the dispute is being measured against. Also per the below lease extract the reference to the 'meter charges' you refer to cannot refer to the meter unit itself as the tenant pays for services used.

'The Tenant must repay the Landlord for all amounts paid by the Landlord in respect of charges levied by service providers supplying services to the Premises, including but not limited to:
Electricity , including basic service and network charges, meter service charges, common area charges and charges in respect of consumption or estimated consumption'
