Elliotte Mobility Damages Goods
<p>Goods were packed and transported from JHB to DBN into storage.</p> <p> </p> <p>Upon opening a box a few weeks later? It was discovered that the pen marker used to mark the boxes by Elliott - has left a mark on one of the curtains.</p> <p> </p> <p>I did pay for insurance and enquired and was told that the claim period is only for 14 DAYS.</p> <p> </p> <p>So forgive me but is it not common to move items directly into storage and only unpacking after 14 days or am i the anamoly here?</p> <p>And if i am not then this insurance does not work, further to that why do i even have to use insurance when the negligence is on Elliott Mobility.</p> <p> </p> <p>For a company to go immediately to a statement refuting claim based on 14 days tells me alot about Elliott being customer centric. My storage element is a norm and thus Eliott should not look at technicalities when it comes to their negligence.</p>

The matter regarding the alleged damaged curtain has been investigated.
This was the only item alleged to have been damaged. The consignment was delivered to a self storage facility on October 12 and the damage was only reported to us on December 9. The insurers application of the 14 day claims time period is is perfectly normal in the insurance industry. You agreed to the terms and conditions when you completed the insurance application form. Furthermore, your allegation that a marking pen used on the top of the carton caused the damage is not possible The curtain was placed into the carton and then the carton was sealed after which the carton was marked so, it's not possible that our marker caused the alleged damage.
Unfortunately, the insurers in this instance were correct in their assessment and accordingly, their repudiation of your claim.

Your logical reasoning is severely flawed. Have you investigated or based your final verdict on assumption?
1. If the Eliott person removing the curtains had a marker in his/her hand? Would it be entirely impossible for them to mark the curtain?
2. Have you tested to see if the marker stain is the same as on the box? You do realise that in the 21st century testing is available?
How can you say it's not possible - i need proof of this.
3. My storage premises has 24/7 CCTV camera monitoring services that can prove how many times i have been in and out with or without boxes but to make it simpler for you to comprehend as i see you may not get it?
I can prove when the box was delivered and when it was open :)

Goodman packed the curtains into the carton, sealed the carton and only then inscribed the description of the contents on the top of the carton. He did not have a marker in his hands when he packed the curtains into the carton.
Of course I have not tested the ink of marker against the writing on the box because I don't have the box and I don't have the marker Goodman used that day to carry out such a test.
On a balance of probabilities it's not possible for us to have stained the curtain.

Our responsibility ceased at that point and you accepted that the delivery was received in good order and to your satisfaction by signing our delivery receipt document. Furthermore, you had in terms of the insurance contract, 14 days within in which to report any claim. This you failed to do.

I am giving you CCTV footage that can be allowed legally in litigation to give you an idea what i did with my stock in reply to your comment "I have no idea what you did with your consignment after it was delivered."

Elliott moility maintained that they were not at fault for the mishap, and that the insurance element had lapsed. However as a sign of goodwill they have made a settlement.
This doesn't replace the good but show's that Elliott still puts the customer first which is commendable, and i will be using them again if i can.
