<p>1. Details:<br />Residing period: 13 December 2016 - 15 December 2016<br />Payment: R2700.00 (2 people for 3 nights at R450 ppn.)<br />Penalty: R900.00 <br />Total: R3600.00</p> <p>2. Background</p> <p>2.1 Arrived at the location on the evening of 13 December 2016 around 8pm.</p> <p>2.2. Paid the outstanding deposit of R1900.00 in cash (R10 change was not given).</p> <p>2.3 The booking was made for 2 people for 2 separate rooms with self- catering for 3 nights.</p> <p>2.4 Up on arrival, Dennis (the owner) showed us the place. It is a two bedrooms apartment which connected by the kitchen and living room in middle. In the living room there is an additional one double bed. There was no separate entrance, everything was linked and we had access to all the rooms and areas.</p> <p>2.5 We asked whether the whole section was for us, the answered was yes. There was no indication by Dennis that which area was off-bound. The assumption was we entitle to use the whole section as we paid for the two rooms.</p> <p>2.6 During the evening, we got cold, so we took the blankets from the 2nd room (that we paid for), and placed on the bed in the living room and the main bed room. There was no other blankets available in the place as we know of, nor did Denis indicated where the additional blankets were.</p> <p>2.7 On 14 December, 2016 around 3pm SA time. Dennis came to us and started a fight with us. He said, we messed up the place and he has new arrival on 16th for 6 people where there will be no time to get everything ready for them. Therefore, he wanted additional R1800.00 cash otherwise he will call the police and arrest us.</p> <p>2.8 After an hour of argument, we ended up paying additional R900.00 for using the other bed room's blanket. He further request that we need to leave the premises before 8am on the 16th. On Booking.com, it was indicated that 10am was the checkout time. He was not willing to give us a receipt, we had to ask him consistently for it.</p> <p>2.9 We have offered to pay for the cleaner, Dennis said no. We offered to hire a cleaner, he said no. All he wanted was the cash.</p> <p>2.10 We had no extra blankets. We been told we cant use the blankets from the other room. We had to wear extra cloths to keep ourselves warm during our sleep.</p> <p>3. Argument</p> <p>3.1 We have rent a place for 2 bed rooms for 3 nights and fully paid for. Therefore, we are entitled to use the place. Please find the attached receipt as annexure A.</p> <p>3.2 We didnt have more people staying in the place. We paid for 2, and only 2 of us were staying there.</p> <p>3.3 We didnt break anything, nor we damaged anything. We didnt smoke in the rooms, nor we remove any furniture. Dennis cant describe where it was a mess, nor he can show where did we damaged anything.</p> <p>3.4 He accessed to the place without out our consent esp went to the main bedroom where the lady was staying, her belonging in the bathroom was moved. We paid for the place, the owner is only entitle to access to the place by informing the Tenant beforehand and not entering at anytime as he likes. He further entered the place without notification where the lady was not fully dressed.</p> <p>3.5 Dennis's argument: he indicated that we were not entitle to use more than two beds. He admitted that he didnt said what was off-bound but his said that it was logical that we should only use two beds (we didnt use the beds, just the blankets on the beds). It was not cold, therefore, we shouldnt have used the other blankets.</p> <p>3.6 He further argued that, we must have the money, because we are rich. We drive a fancy car (we got a rental) and buy seafood (we brought it from the local grocery store). Therefore, we must pay R1 800.00. He was insulting us by calling us names.</p> <p>3.7 We had no option but to explain to him that even though we used "extra" room, we shouldnt pay R1800.00. We only used two additional beds for one night, so its R450 x 2 = R900.00. Which we end up paying. Please find the annexure B with receipt R900.00.</p> <p>3.8 We paid for the rooms. The beds we used were the main bedroom, and bed in the living room, which is the common area. We didnt use the other bedroom, which we paid for, only used the blankets.</p> <p>3.9 We paid for the commons area too. The kitchen, the living room surely, we are entitled to use the bed in the living room. As previously indicated, Dennis didnt mention that we were not entitle to use it.</p> <p>3.10 He forced us out on the 16th at 8am, where we were entitle to only leave the place at 10am at indicated online</p> <p>4. Evidence</p> <p>Annexure C8, the photo of the place. Indicating the rooms are linked with common areas of dining room and the kitchen.</p> <p>5.
