Wrong IMEI number scanned on purchase , no phone

Last year I bought a cellphone at Edgar's in canal walk. I paid the phone in cash, I have my receipt, and also took out cellphone insurance.
A few months ago I had a problem with my phone , and took it to the canal walk Edgar's to have it fixed, the phone was taken in and I was told it will take a few weeks , which was fine.
A few months passed and I didn't hear anything, eventually I went to the store, to be told , that the phone I had repaired and the one i had insured are not the same. The IMEI number entered on the insurance is not the one on the receipt when I bought it?
Now if the sales person at Edgar's did the insurance when I purchased it , whose fault is it? It's been more than 6 months already and I still don't have my phone!!!!
