Return of damaged goods not refunded

On 11th January 2018 I purchased a "Black lace hold up" (similar to socks) which started to ladder at a point were the lace is sewn to the stocking after 10 minutes of using it, it was clearly a quality defect. On going to Edgars on 23rd January 2018 to request a refund, with my proof of purchase, I was told that they would only refund me if the tear happened in store. I asked whether the item was considered underwear since I know this is not covered by the Refund policy and they said it was not due to that that I would not get a refund.

This seems in contravention to the Refund and Exchange policy which clearly states: "Any merchandise deemed to have a quality defect will be refunded or exchanged within a 6 month period if the merchandise was used for its intended purpose, cared for according to the wash/care instruction label and returned with the original proof of purchase. Terms and conditions will apply to selected products."

Edgars return policy needs to be amended to show that it does not cover refunds quality defects.
