Handed Over for Prescribed Debt I received a call from some attorneys telling me they calling on Edcon’s behalf regarding an account with Edgars. I would like to state the following:
1. I had an Edgars account that was closed in 2014.
2. This account was settled by January 2017.
3. From that date I have not had any communication from Edcon with regards to any amounts owing to Edcon.
4. Edcon are to prove to me that I agreed to any amounts owed over the past 5 year, either telephonically or in writing.
5. I want to refer Edcon to the National Credit Amendment Act, published 13 March 2015, prohibits the sale and collection of Prescribed Debt, which confirm the following:
a. The account has been dormant for more than 3 years, you can therefore by law not request any payment from me, pertaining to debt prior to that date. UNLESS I have agreed to do so within those 3 years, either verbally or in writing. Proof of this needs to be provided.
b. Unless, you can prove that this debt is not prescribed, with a signed confirmation from me.
c. I have made no payments to this account since I closed it in 2017.
Edcon (Edgars) are requested to remove my details and remove the claims of money owed against my name on their system and on any credit bureau, failing to do so, I will take legal action against Edcon for ******* practises in terms of the National Credit Act.
