Eagle's Nest Accommodation (Constantia Kloof, JHB)

I purchased a home in Constantia Kloof recently. Unknown to me, the neighbouring property, 1 Bamboes Street is student accommodation. There is no signage and it appears to be a regular house in a residential area. It is called Eagles Nest Accommodation. The property is owned by Daniel Naicker and managed by his son Nathan.

Since moving into my property, the tenants/occupants of 1 Bamboes Street have made my home a nightmare. They have extremely loud, drunken parties from Friday to Sunday every week. Recently, they have included weekdays.

I have made numerous attempts to resolve this matter. I have contacted the owner and manager of the property. I have sought legal counsel. A legal cease and desist letter was delivered by the sheriff to both the owner and tenants. I have also contacted the authorities - JMPD, Florida Police, Honeydew Police (spoken with the captain in person) and Dowry Security. I have been in contact with the local community crime forum chairperson too.

The tenants have ignored the cease and desist letter. They also ignore law enforcement intervention and instruction after authorities leave. The tenants/occupants have escalated their behaviour to harassment, ************ and verbal abuse that includes defamation. They say that I have undermined them and also accuse me of being ****** for going directly to the owner and manager and lodging complaints instead of speaking with them.

I have phone records, WhatsApp correspondence and voice notes, audio and video recordings of the extreme noise disturbance, behaviour and their tenants’ interaction with us. I have also compiled a document on all incidents and reports with names and contact details in sequence. I have sent recordings to the owner and manager. The tenants are also aware that we record for evidence reasons.

The tenants have affected the personal and work lives of my mother and me. We cannot sleep on weekends, public holidays and now weekdays. The tenants are relentless in their harassment. They watch us and call over the wall. They have threatened my mother. They jump on our wall. We cannot see them, but they obviously can see us. One shouldn’t be concerned for their safety in their own home.

I have sought a protection order for the harassment at the Roodepoort Magistrate’s Court. They require the names of the tenants for the application. I have requested them from the owner and the manager. Both have not responded. I contacted the owner telephonically today (Wednesday, 18 December 2019).

From first assisting and encouraging me to report all incidents to them, the owner today stated that I am an irritation - especially for reporting and requesting help - and that I have brought this problem on myself. I don't understand how I did this. He refuses to provide the names and help me identify the tenants from video footage that I have of the culprits (the tenants also refuse to give me their names). He is upset because he is now selling the property and blames me for it. According to him, five agents have visited the property and now they are going to auction it. He says he doesn't want to be involved. He put the phone down on me.

As a property and business owner, one must take responsibility. Eagle’s Nest Accommodation’s stance on this is clear.
