Delivery that never arrived

I have ordered a phone from MTN Mondo & it was supposed to be delivered by DSV. So the driver called me & said he was on his way I waited for him he never arrived. So I then received a call after hours saying that the driver was involved in a car accident. I then told that guy who called that I am going to another location so I don't know if they will be able to bring the phone there he said they will bring it & took my address. I waited again nothing no communication whatsoever. Then the Saturday I went to a MTN to apply for a phone I was approved I then went home since the Sunday I was traveling to Kimberly for training at a military base. Then when I arrive in Kimberly I received a call that they want to deliver the phone I told the lady that I no longer want that phone because of the empty promises from their drivers. The lady said I must send a email to cancel the deliver I did that. Now I am planning to open a case against DSV for ***** because MTN is billing me for the phone I never received.
