Misleading and discriminating email

<p>I received an email (17.05.2017) from MultiChoice with the subject: "DStv Newsletter: New channels now available to all DStv customers!". As I am on a disconinued package (Select) I do not qualify (according to MultiChoice). They neither want to define the word "customer" or admit that they are discriminating by 1st the misleading email and then point out telephonically that the email does not apply to discontinued packages. Why the send me the email in the 1st place. If I am not a MultiChoice customer why do they deduct monthly payments from my bank account. As only a few of their "customers" are still on the discontinued packages the email points to minority supression. I did report it to the ombudsman. Why don't companies learn from mistakes? ...Ford, SPUR.....</p>

According to the Consumer Protection Act No. 68 of 2008, it is mandatory that all suppliers and service providers are required to display labelling and trade descriptions of products, which do not mislead customers about the contents of the packaging or goods attached to the product and all suppliers are not permitted to alter, amend, conceal, remove or deface trademarks and other product labelling, so as to mislead customers. Taking the aforementioned into account, the labelling of the e-mail sent on 17 May 2017 does not conform to the standards of the Consumer Protection Act No. 63 of 2008. Upon my highlighting of this matter, I was told by you (telephonically and via your email below) that I am wrong despite the fact that I technically form part of “all DStv customers” ... point is that the e-mail sent was packaged with a misleading heading.

Reviewer Update

After various emails from / to MultiChoice:

My understanding is that no South African company is excluded from the Consumer Protection Act No. 63 and 68 of 2008. MultiChoice did not comply.

I stand by my view and will await the decision of the ombudsman in this regard.
