Bad Price Lock Deal

In April 2016 I entered into a “Price Lock” contract with MWEB/MultiChoice for a new Explorer DSTV decoder and an MWEB ADSL internet Router complete with installation. The advertised price was R1049 for 24 months.

After the goods were delivered I received a call from an MWEB representative confirming the deal and mentioned that R1299 would be deducted from my account on a monthly basis. I informed him that this was incorrect and that I agreed to R1049 as the advert stated. I also told him that I had confirmed this amount to the previous salesman more than once. This chap said there must have been a misunderstanding in the deal. The reason for the additional amount was the line rental which they said they were not aware of. My previous ADSL system was with MWEB and this may have been a misunderstanding from there side and they are not prepared to budge on the price.

To make the issue worse the new ADSL system supp**** with the deal (which I have had and was working perfectly for the past 28 months) was now very much slower than before. I contacted MWEB and they tried a couple of quick fixes and placed the blame on the line and the wifi system. The end result was they could not do any more.

I have sent MultiChoice a few emails requesting the tape recordings of the telephone conversations but they have ignored them all. To contact somebody at MultiChoice with any authority is virtually impossible.

Are we as consumers obliged to accept this poor service? Could you advise what action I should take from here?

Regards,

Warwick Payton

I placed a complaint with Hellopeter.com on the 22 June 2016 as the agreed “Price Lock” value changed from the time of the agreement and my internet had slowed down after the “upgrade” was implemented.. One hour after placing the complaint a man from MWEB called. The call was ended saying he would follow up and would come back to me. The following day a lady called with numerous questions. Firstly they were to check on the slow internet speeds and secondly they were to listen to the telephone recordings when the agreement was done. At the time the agreement was done telephonically I questioned the bottom line costs and asked if there were any hidden costs involved. I was informed that the agreed value of R1049 was the total amount and this amount would be deducted off my account monthly. I have asked for a copy of these recordings and have been told they do not give them out.

The lady called back the following day to say she had listened to the recordings but only the MWEB recordings. She needed to get the original recordings from MultiChoice as the original “Price Lock” deal was done through them. This was the last I heard from them and as far as I know nothing has been resolved.

At this stage I need to mention that only MWEB has responded to my complaint and although answers are still outstanding, there has been no work from MultiChoice themselves.

MultiChoice undertake these agreements/contracts telephonically and I believe it is a legally binding contract. The big problem is that the end user does not have any documentation or evidence of this agreement unlike a signed document where you get a copy of the deal. Furthermore they will not part with the tapes so how does the end user prove what the originally deal was for. It is a one sided deal and the public/consumers’ need to be made aware of this so they know what they are getting into when conducting a deal telephonically.

To add fuel to the fire and start following up on the problem and just drop it before it is resolved just makes the issue worse. It will not just go away on its own.

Before going to the consumer council/newspapers I need to get legal advice as to where I stand with this deal.

28th July 2016 and still nothing from DSTV or the Price lock department. Clearly DSTV/MultiChoice are just not interested in the problem and have not taken my complaint serious. None of my original complaints have yet been resolved. Time to step up my investigation and go public.
