DOTCOR INSURANCE REFUSE TO PAY CLAIM

(Please proof read and edit if possible) My insurance (Dotsure insurance) has refused to pay for my claim for the car. On the 24th March 2019. I went to play soccer with my friend Lerato, we then went to my friendsflat after the match. I closed the gate with the remote as normal to get something in the house and left Lerato in the car with the car keys inside. When I come back to the car, it was gone. When I went to Lerato’s place he was sleeping as if nothing happened. When I asked him where my car was he said he left it 1000m away next to where he took my car from, when I went to check, the car was not there. I then took the car keys from him and called the tracker and reported the matter to the police station to open a case for car theft. The guy who opened the gate for Lerato has agreed to be my witness that Lerato took my car. Lerato took my car without my permission. My problem is I have been paying for this insurance for Months without skipping any premium but they do not want to pay for the claim saying that I have been negligence. There is nowhere in the contract where it says we will only pay if it not negligence. I did not put my car in an accident on purpose. The insurance must please be reasonable to pay for the claim. The reason we pay for the insurance is when accidents like this happen.

We refer to your Hello-Peter complaint logged on 15 April 2019, contents of which have been noted.

You logged a claim on 24 March 2019 it was declined due to "Lack of due care".  It is unfortunate that you are unhappy with this decision, and this forms the basis of your complaint. 
Our office has investigated the matter and we have found that you drove into a access controlled residence (flats), where you parked your vehicle and left your friend/neighbour in the vehicle with the car key. 
  • You mentioned during the claim verification that your neighbour had consumed alcohol and you told him that he was not allowed to drive the vehicle. 

  • It is also fair to state that you failed to take care to keep the car key safe and under your control.  You should also have foreseen that there are other tenants that accessed the property or that had remotes to the property, which your neighbour asked to open the gate for him.

  • By not taking due care, you substantially increased the risk for possible loss occurring on the vehicle.

  • It is a condition of your policy for you to take all reasonable steps to avoid any loss or damage to everything which is covered by the insurer, and keep all property in good condition, otherwise your claim may be declined. 

In light of our findings, it is our submission that the declination of your claim is in accordance to the terms and conditions of your policy.
