As privately communicated to you, regarding your claim which was instituted on 1 April 2019 for the theft of a Samsung S7 Gold from your unattended vehicle, herewith the reason for repudiation:
1. Theft from unattended vehicles with no violent or forced entry.
During lodgement of the claim, you advised that you left your cell phone in your unattended vehicle and upon your return, the cell phone was missing. We regret to inform you that you have no cover for theft from unattended vehicles unless violence or force is used to get into the vehicle whilst it is securely locked.
2. Incident not reported to the Police.
It was established that the alleged incident was not reported to the police within the stipulated time frame and we are unable to extend cover under these circumstances.
3. Lack of due care
We are of the view that no reasonable steps were taken to prevent the damage or loss and that you exposed the insurer to undue risk by leaving your valuables unattended and we are unable to accept liability under the circumstances.
We refer you to the relevant sections of your policy wording and schedule:
Page 4 TAKING CARE You or any person covered under this policy must take all reasonable steps to prevent loss or damage to everything which is covered by this policy and to keep all the property insured in good condition. If you do not, a claim may be rejected or payment of the claim could be reduced. Page 13 THEFT FROM UNATTENDED VEHICLES You are not covered for loss or damage caused by theft from an unattended vehicle unless the item is hidden from view within the vehicle and violence or force was used to get into the vehicle whilst it was securely locked. Page 15 WHEN YOU WANT TO CLAIM, YOU MUST: 5) Report any event to the police within 24 hours if it involves bodily injury, theft or any ******** act or suspected ******** act or loss of your property. There may be times when we require a SAPS Case reference number (CAS No/CR No/Enq No) for your claim to be valid. If you do not do the above, we may decline your claim.
