I have not acknowledged any debt that DMC claims I owe in the past 3 consecutive years, either in writing or verbally, nor made any payment towards any of the debt, nor have I promised to pay and no summons has been issued against me within the set period (3 years). Any debt in question is therefore prescribed and I'm not legally bound to repay such. I request that any debt under my name be closed with DMC with immediate effect. As it is ******* to be contacted or har***ed for prescribed debt by a credit provider or a third party such as a debt collecting agency due to \since Friday, March 13, 2015, in terms of the new National Credit Amendment Act, it is ******* for a company to contact a consumer and demand that they pay a prescribed debt\". Any debt in question should therefore be closed immediately as it is not collectible no more I demand that I should not be contacted in any form or har***ed for prescribed debt as it is ******* according to the NCA. Please correspond me via email only as I need to keep a record of all interactions. If you continue har***ing my family members on the telephone numbers, which you have clearly obtained *******ly as I have not supp**** you with them, I will report you to the ombudsman and take further legal action.

Thank you for affording us the opportunity to investigate your complaint. Prescription is a defence in law that can be raised should there be no payment, express or tacit acknowledgement of debt for an uninterrupted period of 3 years in respect of personal debt. Often a detailed factual investigation may be required in order to ascertain whether there has been an acknowledgment of the debt. As such each case needs to be adjudicated on the specific facts applicable, with only a competent court of law, in the absence of an agreement, having the authority to pronounce that a debt has prescribed. We have investigated your defence of prescription and addressed your concerns in our correspondence dated 23 May 2016. In light of the aforementioned, we have proceeded to close this query.
