Prescribed debt

Dear DMC,

I am writing to formally request written confirmation regarding a prescribed debt that was previously associated with Markhams TFG account.

In terms of the National Credit Act (NCA) and the Prescription Act 68 of 1969, the account in question has prescribed, as it has been inactive for more than five years. I have never made any payments toward this account, nor acknowledged the debt in any way. TransUnion has also confirmed that the debt is prescribed, and the account is currently reflected as closed on my credit report.

Despite this, the prescribed debt appears to have been sold or handed over to your organisation, which is in clear contravention of Section 126B(1)(a) of the NCA, which states:

"No person may sell a debt under a credit agreement to which this Act applies and that has been extinguished by prescription under the Prescription Act, 1969."

I have previously attempted to contact your office regarding this matter but have not received a response. This lack of communication is unprofessional and unaccaptable

I therefore request that you provide, without further delay, a formal letter confirming:

That the account has prescribed and that the matter is now considered closed. Your urgent attention to this matter is required
