<p>I was looking through my credit report.. And I seem to have an account from Feb 2012. Almost 5yrs old. An account that had an initial R420.. The account is now on R10000+, not only is this account prescribed, but I also fail to understand how an account could go from R420 to R10000+.. In have never acknowledged the account nor have I even paid for it in the past 3 years... Please remove this from my record as it is affecting my history negatively..</p>

Prescription is a defence in law that can be raised should there be no payment, express or tacit acknowledgement of debt for an uninterrupted period of 3 years in respect of personal debt. Often a detailed factual investigation may be required in order to ascertain whether there has been an acknowledgment of the debt. As such each case needs to be adjudicated on the specific facts applicable, with only a competent court of law, in the absence of an agreement, having the authority to pronounce that a debt has prescribed.
